The Eleventh Edition. 485; 520; (xix); 455; (xxvii); 443; (vi)pp. Octavo [21.5 cm] The books have been rebacked with later brown leather and black and red gilt stamped leather spine labels, the edges and corners of the covers restored with the same brown leather, and the majority of the original leather of the boards overlaid. With a frontispiece portrait in volume 1 of William Blackstone printed by Gainsborough. Good condition. The extremities are rubbed, and the underlying boards are exposed occasionally at the corners of the covers. There are sporadic chips in the leather at the heads of the spines. The front cover of volume 1 is nearly detached, and the front cover and front free endsheet and flyleaf of volume 3 are completely detached, but present. There are inscriptions from previous owner's, both contemporary and early twentieth-century, on the endsheets and title pages. There are faint tide marks in the margins here and there, but the majority of the pages are very bright. With the fold-out Table of Descents at p. 241 in volume 2. An eleventh edition of William Blackstone's famous work, a work which presented the English common law as a unified and rational system.

Our copy of Volume I in an unusual "hybrid" because it has text of the earlier edition and the notes from the later edition. The appearance of this set and its binding indicates this set was assembled around 1796. Volume II does not have the Table of Descents and folding Table of Consanguinity. Though indicated in the index, which is at the end of Volume IV, it appears these tables were never issued. Material from the first three essays, which were originally published in 1750, 1758 and 1759, were incorporated into the Commentaries. The final essay, a critical edition of Magna Charta with an interpretive essay, was originally published in 1759. The first critical edition of the charter, it established Blackstone's reputation. According to Eller, there is no bibliographical record of a second edition, so she cites this as the following edition. Commissioned by Sir Charles Mordaunt in the midst of an attempt by Tories to limit voter eligibility in county elections, this early Blackstone essay considers whether certain copyholders might, under limited circumstances, be considered freeholders and given the right to vote. Presented in the format of an extended legal case study, the argument considers both the "true theory and genuine principles of liberty" and the history of land tenure in the common law, threads that Blackstone would pick back up in Book Two of his Commentaries. He concludes that the hypothetical copyholder A.B. "is clearly no freeholder" and cannot be afforded the franchise, regardless of "what would be the best and most equitable constitution for this purpose." The contents of the two editions differ. The first does not have Analysis of the Laws of England (1756) or Observations on the Oxford Press (1757); the "third" does not have Treatise on the Law of Descents in Fee-Simple. With a separate half-title for the "Magna Carta" and table of contents (Tabula) bound between pp lxxvi and 1. Full 19th Century tan paneled calf. Boards ruled in blind. Spine with red morocco spine label, lettered in gilt. Board edges tooled in blind. Marbled endpapers. Edges speckled red. Some rubbing to extremities and corners a bit bumped. Free endpapers reinforced at the front and back. Some light toning to a few pages. The first seven leaves (title, dedication and pages i-x) with repairs to the inner margin and the fore-edges reinforced. Fore-edge of leaf h2 also reinforced. Some small short closed tears to some fore-edges throughout, not touching text. A few cases of marginal worming, again not touching text. Some of the leaves are a bit fragile and torn at the fore-edge, but still a very good copy. "A work of the highest importance for the historian and constitutional lawyer" (David Walker, Oxford Companion to Law). "This work was immediately embraced not only for its scholarship, but also for the highly aesthetic printing. The introductory essay, which represents about half of the volume, is influenced by Lord Coke's interpretation of Magna Carta as the foundation of English liberties. Blackstone's original contributions includes a close examination of the versions of Magna Carta, and represents the first demonstration that all subsequent versions of the charter were based on the 1225 re-issue of Henry III, rather than the original endorsed by King John in 1215. His approach was highly influential and it established the textual focus that has governed subsequent study of the charter. The most influential publication in the history of modern Anglo-American law, the Commentaries on the Laws of England is based on a course of lectures delivered at Oxford University. Because they were not intended for aspiring practitioners, they described general principles rather than practical specifics. Sensitive to the systematizing trends of the day and the prestige of the natural sciences, it described the common law as an intricate, well-designed system akin to Newton's mechanistic universe. It was also an important account of the law's evolution.
